RENEWAL OF EXPIRED OR EXPIRING APPROVALS
Reapplying for an expiring or expired approval under Australia’s Road Vehicle Standards (RVS) legislation involves a structured process to ensure compliance and continuity of operations. Here’s a comprehensive guide to the steps involved:
Determine Eligibility and Timing
Approval holders can reapply within specific timeframes before their current approval expires:
- Vehicle Type and Component Type Approvals: Up to 6 months before expiry.
- Testing Facilities, Registered Automotive Workshops, and Authorised Vehicle Verifiers: Up to 3 months before expiry.
It’s recommended to submit your application at least 60 business days (for vehicle/component approvals) or 30 business days (for other approvals) before expiration to accommodate assessment timeframes.
Access the ROVER Portal
The Road Vehicle Standards System (ROVER) is the online platform for managing approvals. Create or log into your account at the ROVER portal.
Initiate a New Application
Note that existing approvals cannot be varied to extend their expiry date. Instead, initiate a new application for the same approval type. Ensure all required information is provided, as incomplete applications may lead to delays.
Retain Your Approval Number (Optional)
If you wish to retain your previous approval number:
- Include a request in the “Comments and any other matters” section of your new application.
- Provide your existing approval number and explicitly state your desire to retain it.
The department will consider your request, though a new number may be allocated if necessary.
Pay the Commencement Levy (If Applicable)
Some approvals may require the payment of a commencement levy. This fee supports the administration of the RVS legislation. Ensure payment is made promptly to avoid processing delays.
Understand ADR Applicability
For vehicle type approvals, if your application pertains to the exact same model as previously approved, it will be treated as an existing model concerning Australian Design Rule (ADR) applicability. This facilitates the continuous supply of vehicles without the need for additional ADR compliance assessments.
Monitor Application Status
ROVER provides real-time updates on your application’s status, including:
- Draft saved
- Awaiting payment
- Submitted and under assessment
- Approved or refused
- Request for further information
- Withdrawn
You will also receive notifications at various stages, such as when the application is successfully submitted or if additional information is required.
Await Decision
The Department will assess your application within the legislated timeframes. If approved, a new approval number may be issued, unless you requested to retain the previous one. In case of refusal, you may have the option to appeal the decision.
Post-Approval Obligations
Once granted, ensure compliance with all conditions of your new approval. Maintain records and adhere to reporting requirements as stipulated under the RVS legislation.
